Trademark registration gives exclusive rights to use your brand for the goods and services listed in the application. This guide covers the trademark registration process in India from clearance to renewal.
Trademark search and class selection
Search the Indian Trademark Registry and common-law sources for identical or confusingly similar marks. Select appropriate Nice Classification classes for current and planned goods and services.
Filing and examination
File Form TM-A with the representation of the trademark and evidence of use if claiming use. The Registrar examines absolute and relative grounds; examination report or objection must be answered within deadlines.
Publication, opposition, and registration
Accepted marks are advertised in the Trademark Journal. Third parties may oppose within four months. Upon registration, renew every ten years.
