What is a Provisional Patent Application?

Short answer

The applicant must file a complete specification within twelve months of the provisional filing date or the application lapses. Provisional filing validates technology before full prosecution costs (most commonly, startups opt for provisional filing).

Definition

A provisional application is filed with a description of the invention without formal claims. It secures a priority date while the applicant prepares a complete specification.
